Swift Statement cont'd 1
At 2.29pm we went to the nearby police cars. I was aware
that other officers were conducting a search in the area and we remained,
stationary, in the car. I could see another police car ahead of us
containing Detective Constables Greene, Richardson and Hatherley.
At 2.32pm, whilst still in this position, I saw Kim Hatherley walk to the car
containing Dwight Hatherley and appear to hold a conversation with him.
At 2.52pm Dwight Hatherley was driven from the area, Kim Hatherley had been with
him up until this time.
I went with Woman Detective Constable Vickers and Customs Officer Virgil to the
courtyard area at the rear of Hatherley`s Grandmother`s residence where we
waited.
At 3.31pm I saw a man, who I now know as Kemma Belboda, placed into a police
car, adjacent to us, by Detective Sergeant Gibbons, Detective Constable Field,
and Customs Officer Simmons.
Belboda left the vehicle with Detective Constable Field and Customs Officer
Simmons and spoke with a woman nearby.
At 3.40pm the officers returned with Belboda to the police car and we all left
for Hamilton Police Station arriving at 3.47pm.
At 4.17pm, the same day, we left Hamilton Police Station in company with Dwight
Hatherley. At 4.19pm we arrived at Princess Street, Pembroke, the
residence of Lisa Tucker, Hatherley`s girlfriend.
Detective Constable Greene was in possession of the search warrant, that I had
obtained the previous day, relating to the premises and showed it to the
occupier, Mrs Tucker.
I again kept contemporaneous notes of what transpired.
I escorted Hatherley to the premises and Detective Constable Greene said to Mrs
Tucker, "Does Dwight stay here?".
Mrs Tucker said, "No way, he just takes to my daughter that`s it".
Detective Constable Greene said, "Your daughter has her own room?".
Mrs Tucker said, "Yes".
Detective Constable Greene said, "We`ll just take a look around that".
At 4.21pm Mrs Tucker obtained her glasses and read the search warrant saying,
"I don`t understand this?".
Detective Constable Greene explained the warrant to Mrs Tucker and said, "We`ll
just look in Lisa`s room".
I went to the bedroom with Lisa Tucker, Hatherley, Detective Constables Bourne
and with Detective Constable Greene who said, "Is there anything of
Dwight`s in here?"
Miss Tucker said, "No, not that I know of".
Mrs Tucker then came into the room and watched as Detective Constable Bourne
searched.
At 4.27pm Mrs Tucker left the room, returning at 4.28pm.
Detective Constable Greene said, "Lisa, do you have his passport?".
Lisa said, "No".
At 4.29pm Detective Constable Bourne seized a piece of paper from the top right
hand drawer of a drawer unit which was situated against the South wall.
The paper displayed the number `1-215 925 9003`.
Detective Constable Bourne said, "Whose number is it?", showing Miss
Tucker the piece of paper.
She replied, "Suzie, Jason`s sister".
The conversation continued between Detective Constable Bourne and Miss Tucker
and I recorded what was said.
At 4.49pm the search of the room concluded and I wrote the number `1-215 925
9003` onto a piece of paper which I then handed to Lisa Tucker.
At 4.51pm we left the room and Miss Tucker said goodbye to Hatherley.
At 4.52pm Hatherley left the premises in the company of other officers whilst I
returned to the Narcotics Office and secured the exhibits.
At 11.45am, on Sunday, 1st April, 1990, I was in company with other officers,
including Detective Sergeant McLean, Woman Detective Constable Vickers and
Customs Officer Virgil, when we attended the `Sparrow`s Nest` bar on Reid
Street, Pembroke, first floor, front bar.
At about 11.50am, whilst in this bar Detective Sergeant McLean introduced
himself, Customs Officer Virgil and Woman Detective Constable Vickers to a woman
who I now know as Mrs Hatherley.
Mrs Hatherley said, "What you want?".
Detective Sergeant McLean said, "Are you Mrs Hatherley?".
Mrs Hatherley said, "Yes".
Detective Sergeant McLean said, "Is is possible for you to leave here
now?".
Mrs Hatherley said, "I don`t get off until seven".
Detective Sergeant McLean said, "Who is your boss here?".
Mrs Hatherley said, "Mr Minor`s".
Detective Sergeant McLean said, "Where can we contact him?".
Mrs Hatherley said, "At home I guess, I don`t know his number".
I then went to the rear of the premises where I saw a woman sweeping the floor.
As a result of a conversation that I had with her I knocked upon a door at the
North East corner, behind the bar.
I spoke with the manager of the establishment who I now know as Mr Minor`s and
at 11.57am he accompanied me to the front bar where we met with Mrs Hatherley
and Detective Sergeant McLean. Mr Minors granted Mrs Hatherley time off
and she left in company with the Officers.
At 12.20pm the same day, I attended Morgans Road, Warwick and went to the
premises adjacent, and to the North, of the address at which Hatherley and
Harvey were arrested. I spoke with and recorded a witness statement from
the occupiers of the premises Mr Harvey and his daughter Deborah.
I left the premises at about 1.15pm and went to the address at the rear of the
house in which Harvey and Hatherley had been arrested. Here I met with Mrs
Albouy who was dictating a statement to Detective Constable Severin which
concluded at 2.05pm.
At 2.12pm we left the premises returning to the Narcotics Office.
At 4.28pm the same day I attended Hamilton Police Station in company with
Detective Sergeant McLean.
Mrs Hatherley was in the North gaol area interview room in company with Woman
Police Constable Lorna Richardson, both ladies then went to the front of the
station.
At 4.33pm I again saw Dwight Hatherley and, in company with Detective Sergeant
McLean, accompanied him to the South interview room, whilst making
contemporaneous notes.
Detective Sergeant McLean said, "You still want to speak with me along
Dwight?".
Hatherley said, "Yeah".
I left both men in the interview room and waited in the main gaol area.
At 4.40pm I saw Hatherley walk briskly through the gaol area, speaking with no
one. Without stopping or speaking to anyone he walked directly to the cell
area.
I went to Detective Sergeant McLean in the interview room and at 4.47pm, when
Detective Sergeant McLean had finished writing we left the area.
At 5.15pm, the same day, I made local enquiries with regard to the `Louis
Vuitton` key that was in Hatherley`s possession when arrested on Friday, 31st
March, 1990.
At 5.40pm I returned to the Narcotics office.
At 7pm the same day I attended Hamilton Police Station in company with Detective
Constable Bourne.
At 7.20pm I saw Mrs Hatherley and restored to her the cash and personal effects
taken from Morgans Road at the time Dwight Hatherley, her son, was arrested on
Friday, 31st March, 1990. Mrs Hatherley signed the receipts pertaining to
these items, numbered CO532 and CO533.
At 7.25pm, in company with Detective Constable Bourne, in the gaol area
interview room, at the North side, I conducted an interview with Dwight
Hatherley which I recorded contemporaneously on `caution statement` forms.
At 7.25pm I said,"Dwight, I am Detective Constable Philip Swift and this is
Detective Constable Bourne. We are dealing with you in relation to the
offence for which you have been arrested, namely conspiracy to import a
controlled drug. With regard to this you are not obliged to say anything
unless you wish to do so, but what you say may be put into writing and given in
evidence. Do you understand this?"
Hatherley said, "Yes, I understand this".
I said, "I understand that you have been given an opportunity to make a
statement in relation to this matter already,but I again give you the
opportunity. Do you wish to make a statement in relation to this matter,
it will be written down?".
Hatherley said, "I wish to make no statement".
I said, "I wish to put some questions to you in relation to this matter,
namely the offence of conspiracy to import a controlled drug. You are not
obliged to answer any of these questions, but if you do the questions and
answers will be taken down in writing and may be given in evidence. Do you
understand this?".
Hatherley said, "I understand".
I said, "With regard to your arrest and subsequent search of your premises
last Friday, 30th March 1990 a number of items were seized by DC Bourne and
myself, do you recall this?".
Hatherley said, "I remember that".
I said, "Please tell me what of yours we seized?"
Hatherley said, "Hard earned money".
I said, "Dwight, I would appreciate your giving full answers if you can, it
saves me keep recording questions. Can you tell me specifically where that
money came from?".
Hatherley said, "I worked for it".
I said, "Doing what?".
Hatherley made no reply.
I said, "What do you do for employment?".
Hatherley said, "I have already answered that".
I said, "You referred to us seizing some keys, to which keys are you
referring?".
Hatherley said, "They were all attached to a brown key case".
I said, "How many keys?".
Hatherley said, "Between five and eight, I`m not exactly sure".
I said, "Can you describe what the keys were for?".
Hatherley made no reply.
I said, "Can you recall what the keys were for?".
Hatherley made no reply.
I said, "We seized some records at the house from upon the Bar. Whose
are these?".
Hatherley said, "Those belong to either my sister, my mother or my
grandmother, they`re not mine".

I said, "Dwight, do you know to whom these records belong?".
Hatherley said, "I`m not sure".
I said, "Are they yours?".
Hatherley said, "No".

Hatherley said, "I don`t remember you taking all this. I think you
must have taken them after I left the house, I think that`s against the
law".
I said, "They were taken when you were arrested, in your presence and
recorded by me, upon a set of notes which bear your signature. I assure
you that we took them at the time of your arrest. To whom do they
belong?".
Hatherley said, "They belong in the house".
I said, "Do you write in them?".
Hatherley said, "No, I don`t".
I said, "Have you ever written any telephone numbers on them?".
Hatherley said, "No".

I said, "To whom do these belong?".
Hatherley said, "They belong to me (points to screw drivers) that (points
to pliers) belongs to my grandmother".
I said, "By they do you mean the screw drivers?".

Hatherley said, "I have lots of tools".
I said, "Why were these the only ones we found?".
Hatherley made no reply.
I said, "I am showing you a yellow piece of paper bearing handwriting.
Is this your handwriting?".
Hatherley said, "Nope".
I said, "Whose handwriting is it?".
Hatherley made no reply.
I said, "Who is Rebecca Boatman?".
Hatherley said, "I haven`t the faintest idea".
I said, "Who is Judy?".
Hatherley said, "I don`t know".
I said, "I am showing a white piece of paper bearing letters and numbers,
handwritten, whose handwriting is this?".
Hatherley made no reply.
I said, "Do any of the numbers mean anything to you?".
Hatherley said, "No, they don`t".
I said, "I am showing you a brown note book, on the cover is the number
976-1616, whose book is this?".
Hatherley said, "I don`t know".
I said, "I am showing you a green `telephone and address` book, whose book
is this?".
Hatherley said, "I don`t know".
I said, "Does it belong to your mother?".
Hatherley said, "Either my mother or my sister".
I said, "I am showing a blue Memo book, whose book is this?".
Hatherley said, "I have no idea".
I said, "Whose address is 176-328 Memorial Parkway, New Brunswick, N.J.
08903?".
Hatherley said, "I have no idea".
I said, "I am showing you a piece of paper bearing the telephone number
292-5670, whose number is this?".
Hatherley said, "I have no idea".
I said, "What was your mother`s length of stay in the United States?".
Hatherley said, "No reply".
I said, "I am showing you a set of five keys on the same link, do you
recognise these?".
Hatherley said, "Yes, I do".
I said, "How do you recognise them?".
Hatherley said, "They`re mine".
I said, "What are the keys to?".
Hatherley said, "They`re to my house".
I said, "Which address are they to?".
Hatherley said, "Morgans Road".
I said, "Which keys are for Morgans Road?".
Hatherley said, "They are all for the same house".
I said, "One key is marked `Long lock T46`, what is this to?".
Hatherley said, "No reply".
I said, "One key is marked `Master` on one side, and `A1407` on the other,
what is this for?".
Hatherley said, "No reply".
I said, "One key is marked `Louis Vuitton` on one side and 1019531 on the
other. What is this for?".
Hatherley said, "It came with the key case".
I said, "I understand `Louis Vuitton to be the makers of luggage, how is it
that you come to have this key?".
Hatherley said, "It came with that key case, maybe they give it to you as a
souvenier".
I said, "When did you get that key case?".
Hatherley said, "About four years ago".
I said, "Where from?".
Hatherley said, "San Francisco".
I said, "How much was it?".
Hatherley said, "I don`t remember".
I said, "Did you get it new?".
Hatherley said, "Yes, I did".
I said, "Do you have any Louis Vuitton luggage?".
Hatherley said, "No, I don`t".
I said, "Does any of your family have any Louis Vuitton luggage or
goods?".
Hatherley said, "No reply".
I said, "It is my information that this key is issued with a piece of
luggage, a case, trunk or brief case. Do you know anyone who owns such an
item?".
Hatherley shook his head and said, "No reply".
I said, "I am showing you a typed list of telephone numbers, which I would
like you to look at".
HANDS TO DWIGHT - EXPLAINS THE SYSTEM OF TYPING, THE LOCAL CODES FOLLOWED BY THE
FOUR DIGIT NUMBER.
Hatherley said, "None of them means anything to me".
DWIGHT CONTINUES TO LOOK AT LIST.
I said, "You are welcome to sign this list as I have done if you wish.
I have also added the time at which I handed it to you. Do you wish to
sign it?".
Hatherley said, "No".
At 2021 hours Dwight returns list.
I said, "I am finished with regard to the items seized from your house,
there are just a few points I wish to clarify. With regard to the
collection of the T.V.`s, it is my information that your mother went to the
Airport to arrange delivery. Is that corret?".
Hatherley said, "No, she did not".
I said, "Who went?".
Hatherley said, "I arranged the delivery, my mother dropped off the
receipt".
I said, "How did she come to be in possession of the receipt?".
Hatherley said, "I gave it to her to deliver".
I said, "When did you give it to her?".
Hatherley said, "At the house at Morgans Road".
I said, "When did you give her that receipt?".
Hatherley said, "Thursday afternoon".
I said, "Was anyone present whenyou handed her that receipt?".
Hatherley said, "No".
I said, "Are you sure it was you that handed her that receipt?".
Hatherley said, "I`m positive".
I said, "What did you tell her to do with the receipt?".
Hatherley said, "I asked her to deliver the receipt to Rafur
Trucking".
I said, "What did you tell her the receipt was for?".
Hatherley said, "I don`t remember".
I said, "Why did you give her the receipt?".
Hatherley said, "Because I`m off the road".
I said, "When did you get the receipt?".
Hatherley said, "I got it when I bought the T.V.`s".
I said, "When did you buy the T.V`s".
Hatherley said, "No reply".
I said, "Who did you buy the T.V.`s for?".
Hatherley said, "No reply".
I said, "Was that receipt the only document that you given when you bought
the T.V.`s?".
Hatherley said, "Yes".
I said, "Were you given a Warranty?".
Hatherley said, "No reply. I don`t know, they were probably in the
boxes".
I said, "Did you ask for a Warranty?".
Hatherley said, "No reply".
I said, "Did the T.V.`s come with a Warranty?".
Hatherley said, "No reply".
I said, "Who was with you when you bought the T.V`s?".
Hatherley said, "I was by myself".
I said, "Where did you obtain them from?".
Hatherley said, "It`s on the receipt, I don`t remember".
I said, "How did you pay for them?".
Hatherley said, "I paid for them in cash".
I said, "How much?".
Hatherley said, "Whatever the receipt says".
I said, "What sort of T.V.`s are they?".
Hatherley said, "G.E., No reply".
I said, "What size are they?".
Hatherley said, "Twenty six inch".
I said, "Are they the sort with flat screens, modern?".
Hatherley said, "No reply".
I said, "Do you know much about T.V.`s?".
Hatherley said, "Nope".
I said, "Do the T.V.`s work?".
Hatherley said, "No reply".
I said, "What assistance did you receive to choose those specific
T.V.`s?".
Hatherley said, "What do you mean?".
I said, "I mean who helped you with the specifics?".
Hatherley said, "No reply".
I said, "Why did you choose 26"T.V.`s?".
Hatherley said, "No reply".
I said, "Was one of the T.V.`s intended for your mother?".
Hatherley said, "No reply".
I said, "Who were the T.V.`s for?".
Hatherley said, "No reply".

Hatherley PAUSED.

I said, "Where were you staying?".
Hatherley said, "No reply".
I said, "Did you complete a Bermuda Immigration card in respect of this
trip to buy the T.V.`s?".
Hatherley said, "No reply".
I said, "How long have lived at Morgans Road?".
Hatherley said, "I`ve lived there all my life".
I said, "How well do you know your neighbours?".
Hatherley said, "Very well".
I said, "Do you know their names?".
Hatherley said, "Yes, I do".
I said, "Do you know the Harvey`s?".
Hatherley said, "Yes, I do".
I said, "Do you know Jimmy Harvey?".
Hatherley said, "Yes, I do".
I said, "How well do you know Jimmy Harvey?".
Hatherley said, "We grew up in the same neighbourhood".
I said, "Did you buy any of the T.V.`s for him?".
Hatherley said, "No".
I said, "Did you buy the T.V.`s or one of them for his family?".
Hatherley said, "No".
I said, "Had you arranged with Jimmy for him to receive either or both of
the T.V.`s?".
Hatherley said, "No".
I said, "Why did you address the T.V.`s to Jimmy Harvey?".
Hatherley said, "No reply".
I said, "When you sent your mother to hand the receipt for the T.V.`s to
Rufur did you tell her to whom they were addressed?".
Hatherley said, "No".
I said, "Why not?".
Hatherley said, "No reply".
I said, "Did your mother comment on the receipt being in Jimmy Harveys
name?".
Hatherley said, "The receipt is not in Jimmy Harvey`s name, there are two
receipts".
I said, "What do you mean by two receipts?".
Hatherley said, "One for the Airline, one for the T.V.`s".
I said, "Did you complete them both, the receipts?".
Hatherley said, "No reply".
I said, "Did you sign any correspondence, when you purchased the
T.V.`s?".
Hatherley said, "No reply".
I said, "Who placed the T.V.`s in your house at Morgans Road?".
Hatherley said, "Rafur Trucking".
I said, "Were they the T.V.`s you purchased in the U.S.?".
Hatherley said, "Yes".
I said, "How do you know this?".
Hatherley said, "Well they look exactly like them, if not the T.V.`s
themselves".
I said, "When did you remove the back of the T.V.`s?".
Hatherley said, "No reply".
I said, "Who placed the silver duct tape packets, that you saw removed from
them yesterday, in the T.V.`s?".
Hatherley said, "I have no idea, I have never seen them before".
I said, "Were they in the back of the T.V.`s when you bought it?".
Hatherley said, "I never looked in the T.V.`s when I bought them, that`s in
the back".
I said, "Where they in the back of the T.V.`s anytime after you bought
them?".
Hatherley said, "I`ve never seen them before".
I said, "The packages that I am referring to are the ones that were made of
silver duct tape and contained plant material which we suspect is Cannabis, have
you ever seen them before?".
Hatherley said, "I`ve never seen them before".
I said, "Were there any similar looking packages in the back of the
T.V.?".
Hatherley said, "I never looked in the back of the T.V. at all".
I said, "Obviously somebody removed that back of the T.V.`s to get the
packages in, was that you?".
Hatherley said, "I never removed the back of the T.V. Maybe they were
put in there before I bought the T.V.`s or after I shipped the T.V.`s".
I said, "Who do you think would put the above mentioned packages into the
T.V.`s?".
Hatherley said, "I have no idea".
2111 RECORD HANDED TO DWIGHT - APPEARS TO READ
Whilst reading the record of questions and answers Hatherley remained quiet.
DC Bourne excused himself to make phone call.
At 9.14pm Hatherley said, "You know, watching you when I was arrested I got
the impression that you were the only one who knew what he was doing but now I
can see you don`t".
I said, "Like a lot of things, some times I only understand a little of the
larger picture. I had the easy job, all I had to do was take notes".
Hatherley continued reading, occasionally taking the paper and knocking the long
edge against the table.
Hatherley said, "Well someone`s not going to be very happy".
DC Bourne returns to doorway, standing just in corridor, door ajar.
I said, "No you`re right, at the end of the day that is a lot of drug to
lose".
Hatherley said, "Yep, you`re right there".
I said, "Somebody will be very disappointed".
Hatherley said, "Yep, and to think, your Sergeant had the opportunity to
find out who".
I said, "And because of that I am convinced of your guilt".
Hatherley said, "Well you can`t prove that, you have something on my mother
and Jason but nothing on me, they`re innocent and I gave your Sergeant the
chance to find out why".
I said, "Do you realise young man just how much that incriminates
you".
Hatherley said, "You never heard me say that".
I said, "Oh yes I did and so did Officer Bourne here".
Hatherley said, "Well I guess it`s my word against yours".
I said, "That`s all it ever is".
Hatherley said, "You`re right there".
Hatherley continued to read in silence.
2123 DWIGHT RETURNS RECORD
Hatherley said, "Hope you didn`t forget anything in that last chat we
had".
I said, "No, it is all recorded upon this yellow piece of paper".
I said, "Dwight you have read the above record, all twelve pages, and I
have just read your last comment back to you. Is there anything that you
wish to alter or correct?".
Hatherley said, "No comment".
I said, "Is this record true?".
Hatherley said, "No, it`s not".
I said, "In what way is it not true?".
Hatherley said, "No comment".
I said, "Again then I give you the opportunity to put right any part of it
which you wish to correct, alter or add, it is the record I have made of your
replies to my questions. Do you wish to change anything?".
Hatherley said, "That`s no record".
I said, "Would you like, or care to explain that remark?".
Hatherley said, "No comment".
I said, "With regard to the twelve pages you have just read, would you like
to add, alter or correct anything contained in them?".
Hatherley said, "No comment".
I said, "Did you make this record of your own free will?".
Hatherley said, "No comment".
I said, "Do you wish to sign the record?".
Hatherley said, "No I don`t".
I said, "Do you wish to initial my mistakes?".
Hatherley said, "No".
I said, "Do you wish to read this last page, page thirteen (13)?".
Hatherley said, "No, I don`t".
The record was concluded at 9.34pm and, in the presence of Hatherley, I recorded
upon the last page:
"Record recorded 1-4-90, from 7.25pm to 9.34pm. No breaks taken.
No refreshments provided, however Dwight was in possession of a soda as he
entered the room and continued to drink from it during the interview. D.C.
Bourne present".
At 9.34pm Hatherley was returned to the cell and, in company with Detective
Constable Bourne, I returned to the Narcotics Office.
At 9.16am, on Monday, 2nd, April, 1990, as a result of information obtained from
Hatherley and recorded in the contemporaneous notes made the previous evening, I
made further, overseas, enquiries concerning the `Louis Vuitton` key.
At 9.40am, the same day, I went to the residence of Mr. Ming, a Justice of the
Peace, at Jubilee Road, Devonshire,
and obtained a Misuse of Drugs search warrant in the name of Mrs. Williams
of Dudley Hill, Paget.
At 10am I returned to the office.
At 10.35am I left the Narcotics Office in company with Detective Sergeants
McLean and Gibbons and Detective Constable Bourne.
We arrived at Hamilton Police Station at 10.43am.
At 10.45am Hatherley was brought to the gaol area from his cell and I showed him
the search warrant relating to Mrs. Williams of Dudley Hill, Paget. I then
cautioned Hatherley in accordance with Rule two (2) of the Judges Rules and
informed Hatherley that we would be going to Dudley Hill, Paget. Hatherley
was then handcuffed, using handcuffs from the gaol area, with his hands to the
front of him.
Hatherley said, "I ain`t going, there`s no one there".
I kept contemporaneous notes of what transpired and we left the gaol area and
stopped in the hallway where Hatherley used the drinking fountain.
I said, "How can we contact someone".
Hatherley said, "You can`t".
Detective Sergeant McLean explained that we will not take too long and asked
Hatherley for his Grandmother`s telephone number.
Hatherley said, "You not already got it?".
Detective Sergeant McLean said, "Have you got a key for the house?".
Hatherley said, "No".
Detective Sergeant Gibbons said, "Where does your Grandmother work?".
Hatherley said, "Belmont, what you gonna do, drag her out of her work you
punk".
Detective Sergeant Gibbons said, "No we`re going to invite her to attend,
if she doesn`t wish to attend then you will be present".
Hatherley said, "I`m waiting for my Attorney".
Detective Sergeant McLean said, "Why didn`t you tell us that
earlier?".
Hatherley remained silent.
Detective Sergeant McLean then left the area and went to the station area.
At 10.51am Hatherley said, "If you want to search she knocks off at one
o`clock can`t you wait till then".
Detective Sergeants McLean and Gibbons then left the area.
At 10.53am Hatherley said, "I also believe my seventy two hours is
up".
Hatherley then remained silent.
At 10.57am Detective Sergeant Gibbons returned to the area.
At 10.58am Detective Sergeant McLean returned to the area and left with
Detective Sergeant Gibbons. Hatherley remained silent.
At 10.59am Detective Sergeants McLean and Gibbons returned and we all left the
Police station for Dudley Hill, Paget.
Hatherley was in company with Detective Sergeant Gibbons and I. Detective
Sergeant McLean and Detective Constable Bourne were in a vehicle ahead of us.
As we drove to the Belmont Hotel, Warwick, I again showed the search warrant to
Hatherley who said, "Can I ask what you are looking for?".
I was seated next to Hatherley in the rear of the police car behind the driver,
Detective Sergeant Gibbons, and I said, "I wish to find out what your keys
are to. When I questioned you about them last night you were somewhat
evasive in answering".
Hatherley said, "Evasive, I`ve told you all I know".
I continued to make contemporaneous notes.
I said, "Hardly".
Hatherley laughed and then was silent.
At 11.14am we arrived at the Belmont Hotel and Hatherley was still silent.
I saw Detective Sergeant McLean enter the Belmont Hotel whilst Detective
Sergeant Gibbons, Hatherley and I, remained outside with Hatherley
At 11.29am Detective Sergeant Gibbons left our car and went to Detective
Sergeant McLean, returning after about a minute.
At 11.30am we left the Hotel and met with Mrs Williams on the drive way.
Mrs Williams said, "You`re very persistent, I don`t like all this crap on
my job".
At 11.31am Mrs Williams handed to Detective Sergeant Gibbons a key.
Detective Sergeant Gibbons apologised for the inconvenience caused.
Hatherley remained silent.
Detective Sergeant Gibbons handed the key to me and, as we drove toward Dudley
Hill, Paget, I checked it against the keys attached to the `Louis Vuitton` purse
that had been found in Hatherley`s possession at the time of his arrest on
Friday, 30th March, 1990.
At 11.33am I said to Hatherley, "I believe that the key that your
Grandmother just handed me is identical to the key on your ring marked `Weiser`,
am I correct?".
Hatherley said, "No reply".
I said, "I am going to use your key to enter your Grandmother`s residence
will it open the lock?".
Hatherley was silent.
